Terms of Service

The Short Version

SyncMuse is a collaboration platform for musicians. You upload your music, we host it, you control who sees it. We don't claim ownership of your work. Don't upload stuff you don't have rights to. Be a decent human. Pay for what you use.

1. What SyncMuse Is

SyncMuse provides cloud storage, version control, and collaboration tools for musicians. It's a B2C SaaS product—not a record label, not a distribution service, not a social network.

The service is provided "as is." We're not certified for industry-specific compliance (HIPAA, FISMA, etc.), and we're not pretending to be.

2. Who Can Use It

You must be at least 18 years old to use SyncMuse.

By registering, you confirm that:

  • Your registration info is accurate
  • You have the legal capacity to agree to these terms
  • You won't use bots, scrapers, or automated tools to access the service
  • You won't use SyncMuse for anything illegal

3. Your Account

  • You need to register to use SyncMuse
  • Keep your password secure
  • You're responsible for everything that happens under your account
  • If you suspect unauthorized access, tell us immediately

4. Your Content

You own what you upload. We don't claim ownership of your tracks, stems, or project files.

By uploading content, you grant SyncMuse a limited license to:

  • Host, store, and back up your content
  • Display it to collaborators you've invited
  • Technically process it as needed to operate the service (transcoding, waveform generation, etc.)

That's it. We won't sell your stems, use your tracks in marketing without permission, or claim any creative rights to your work.

You're responsible for what you upload. You warrant that you have the necessary rights to all content you post—samples, stems, vocals, everything.

5. What You Can't Do

General Prohibitions

  • Scrape, crawl, or systematically extract data
  • Circumvent security features
  • Upload malware or malicious code
  • Impersonate others
  • Harass, abuse, or harm other users
  • Interfere with or disrupt the service
  • Reverse engineer or decompile the software
  • Sell or transfer your account
  • Use SyncMuse to spam or run pyramid schemes
  • Commit payment fraud or chargeback abuse

Music-Specific Prohibitions

  • Upload content you don't own or lack rights to (stems, samples, beats, vocals)
  • Distribute third-party content without permission
  • Circumvent or tamper with DRM protection
  • Upload someone's voice without their consent
  • Use synthetic voice generation without disclosure
  • Share others' personal information (doxxing)

Content Prohibitions

  • Illegal content
  • Hate speech
  • Harassment or threats
  • Sexualization of minors or exploitation material

Violations may result in immediate termination and, where appropriate, legal action.

6. Our Intellectual Property

SyncMuse (the platform, not your content) belongs to us—the code, design, features, branding, and documentation. You get a non-exclusive, non-transferable, revocable license to use the service while you're a paying customer or on a free plan.

Don't copy, rebrand, or resell the platform itself.

7. Payments and Subscriptions

  • Payment methods: Visa, Mastercard, American Express, PayPal (processed by FastSpring)
  • Pricing: In US dollars
  • Billing: Subscriptions automatically renew unless you cancel. By subscribing, you consent to recurring charges.
  • Free trial: New users get a 14-day free trial. Cancel before it ends and you won't be charged.
  • Cancellation: Cancel anytime in your account settings. Cancellation takes effect at the end of your current billing cycle. No partial refunds.
  • Price changes: We may change subscription fees with reasonable advance notice.

8. Data and Backups

We take reasonable measures to protect and back up your data. We're not a "dumb pipe" that disclaims all responsibility the moment something goes wrong.

That said, we strongly recommend keeping local copies of your important project files. No cloud service is infallible, including us.

9. Service Availability

We aim for high uptime but don't guarantee it. We may:

  • Perform maintenance (with notice when possible)
  • Experience outages beyond our control
  • Modify or discontinue features

We're not liable for interruptions, though we'll do our best to minimize them and communicate clearly when they happen.

10. Privacy

Our Privacy Policy explains how we handle your data. By using SyncMuse, you agree to those practices.

11. Copyright and DMCA

We respect intellectual property rights. If you believe content on SyncMuse infringes your copyright, contact our designated agent:

Include:

  • Identification of the copyrighted work
  • Identification of the infringing content
  • Your contact information
  • A statement of good faith belief
  • A statement of accuracy under penalty of perjury
  • Your signature

We'll investigate and respond appropriately, including removing infringing content and terminating repeat infringers.

12. Termination

By you: Cancel anytime in your account settings.

By us: We may suspend or terminate your account without warning if you violate these terms. Upon termination, your license ends immediately and you lose access to your content.

If we terminate your account for cause, you can't create a new one without our permission.

13. Disclaimer

SyncMuse is provided "as is" and "as available." We don't warrant that it will be error-free, secure, or uninterrupted.

To the extent permitted by law, we disclaim all warranties—express or implied—including merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of Liability

To the maximum extent permitted by law:

  • We're not liable for indirect, incidental, special, consequential, or punitive damages
  • Our total liability is capped at the amount you've paid us in the six (6) months prior to the claim

Some jurisdictions don't allow these limitations. If that's you, some of this may not apply.

15. Indemnification

You agree to defend, indemnify, and hold harmless KST Development from claims arising from:

  • Your content
  • Your use or misuse of SyncMuse
  • Your breach of these terms
  • Your violation of third-party rights

16. Disputes

Informal resolution first: Before filing any formal claim, contact us at info@syncmuse.co. We'll try to resolve it within 30 days.

Governing law: These terms are governed by the laws of South Korea.

Jurisdiction: If informal resolution fails, disputes will be submitted to the courts of South Korea.

17. Changes to These Terms

We may update these terms. If we make significant changes, we'll notify you via email or in-app notice. Continued use after changes constitutes acceptance.

18. Miscellaneous

  • These terms are the entire agreement between you and KST Development
  • If any provision is unenforceable, the rest remains in effect
  • Our failure to enforce a right isn't a waiver of that right
  • You can't transfer your account or rights under these terms
